Diana v State Board of Education (1972)

1. class action suit on the behalf of 9 Hispanic and African American children placed in classes for children with educable mental retardation (EMR).
2. the case was settled by a Stipulated Agreement Settlement in favor of the plaintiffs (the parents and children) stating that:
   • children must be tested in their native language
   • all Hispanic and African American student currently placed in classrooms for children with EMR must be retested in their native language
