Module Three

Activity Three - Rights of children and laws with respect to IDEA

Look for documents that protect the rights of children to receive a free and appropriate public education. Remember to include the parts of IDEA that address mental health and the rights of children who are creating discipline issues in the school. Find at least three documents that address the rights of children to receive a free appropriate public education despite their behaviors, if they have documented disabilities and an IEP. Distinguish between children who are not receiving services through the special education law and those who are found eligible for services.

Now find at least eight court cases that address the educational rights of youth who are being served under IDEA. There is a pattern, beginning with Tinker, providing children with constitutional rights guaranteed to adults.

Finally, make a timeline of the initial determination of school responsibility with respect to serving youths with IEP’s and changes to the current time with respect to suspension and expulsion of children who are receiving services under IDEA.
