Activity Five - District policy and parent brochure
Each district should have policy established to cover expulsion, suspension and
behavioral issues. It is important for you, as an employee to know what those
policies stipulate. It is also important for consistent ideas to be represented
to youngsters regarding their rights and responsibilities.
Since the changes in the law that occurred in IDEA 1997, it became clear that
parents rights were held with deep respect and regard. Parents have due process
to help them learn about their rights. Still, after wandering through laws and
court cases, it is easy to see that the concepts are difficult and fraught with
emotion, opinion and continuing changes.
As a culmination of the module on laws, read the district policy on students
who get in trouble at school and then prepare a two-sided brochure for parents,
explaining their rights and some of the most basic services that students may
receive.
To help focus your attention, you may want to address some of the following questions
or issues.
What if a child with a disability gets into trouble at school and is suspended
or expelled?
Can a suspension be appealed?
Suspensions lasting 10 school days or less:

What is a Manifestation Determination?
What is a Functional Behavioral Assessment?
What is a Positive Behavior Intervention Plan?
What if a child is involved in a weapons or illegal drug offense?
What should parents do if they disagree with the change of placement or the manifestation
determination?
